1. Nature of the Platform

Hazirkar (“Platform”) is a digital technology platform that facilitates communication between individuals seeking services (“Customers”) and independent service professionals (“Service Providers”), including but not limited to electricians, plumbers, masons, carpenters, painters, barbers, domestic helpers, labourers, mechanics, and other skilled or unskilled workers.

Hazirkar is solely an intermediary platform and does not provide, supervise, control, or guarantee any services offered by Service Providers.

By using the Platform, you acknowledge that Hazirkar is not a party to any agreement entered into between Customers and Service Providers.

2. No Employment Relationship

Hazirkar does not employ, appoint, engage, supervise, or control any Service Provider.

Every Service Provider registered on the Platform is an independent individual who is solely responsible for the services offered by them.

Nothing contained in these Terms shall be construed as creating an employer-employee relationship, agency, partnership, joint venture, franchise, or contractor relationship between Hazirkar and any Service Provider.

3. No Payment Handling

Hazirkar does not:

  • collect service charges;

  • receive customer payments;

  • transfer money;

  • operate any escrow service;

  • provide payment gateway facilities;

  • collect commissions on completed services.

Any payment for services is negotiated and settled directly between the Customer and the Service Provider.

Hazirkar is not responsible for:

  • payment disputes;

  • non-payment;

  • overcharging;

  • refunds;

  • advances;

  • deposits;

  • cancelled work;

  • pricing disputes.

4. No Commission

Hazirkar currently provides its platform free of charge.

Neither Customers nor Service Providers are required to pay any platform fee, commission, membership fee, subscription, brokerage, or referral fee unless expressly announced in writing in the future.

Hazirkar reserves the right to introduce paid services at a later date after providing appropriate notice to users.

5. Independent Agreement

Once a Customer contacts a Service Provider through Hazirkar, any agreement regarding:

  • work,

  • price,

  • duration,

  • quality,

  • warranty,

  • payment,

  • materials,

  • labour,

is solely between those two parties.

Hazirkar is not involved in such negotiations.

6. No Guarantee

Hazirkar does not guarantee:

  • availability

  • skill

  • quality

  • honesty

  • behaviour

  • punctuality

  • identity

  • licensing

  • background

  • pricing

  • experience

  • successful completion of work

Customers must exercise independent judgment before hiring any Service Provider.

7. Identity Verification Disclaimer

Hazirkar may request documents such as:

  • Aadhaar Card

  • PAN Card

  • Driving Licence

  • Passport

  • Voter ID

  • Photographs

  • Address Proof

Submission of documents does not mean Hazirkar certifies or guarantees the identity, qualifications, integrity, criminal background, or professional competence of any Service Provider.

8. User Responsibility

Every user is solely responsible for:

  • verifying identity;

  • negotiating service terms;

  • ensuring workplace safety;

  • inspecting completed work;

  • complying with applicable laws.

Hazirkar encourages users to verify credentials independently before engaging any Service Provider.

9. Limitation of Liability

To the maximum extent permitted under applicable law, Hazirkar, its owners, directors, employees, developers, affiliates, licensors, and representatives shall not be liable for any direct, indirect, incidental, consequential, punitive, special, or exemplary damages arising out of or related to:

  • the acts or omissions of any Customer or Service Provider;

  • service quality or workmanship;

  • delays or non-performance;

  • disputes between users;

  • personal injury;

  • death;

  • property damage;

  • theft;

  • fraud;

  • misconduct;

  • negligence;

  • financial losses;

  • loss of profits;

  • emotional distress; or

  • any other claim arising from services arranged through the Platform.

Users acknowledge that they engage with each other entirely at their own discretion and risk.

10. Indemnification

Users agree to indemnify, defend, and hold harmless Hazirkar, its owners, employees, officers, directors, affiliates, agents, developers, and licensors from any claims, liabilities, damages, losses, expenses, costs, or legal fees arising out of:

  • misuse of the Platform;

  • violation of these Terms;

  • disputes between users;

  • violation of applicable law; or

  • infringement of third-party rights.

11. Privacy & Data Protection

Hazirkar respects user privacy and processes personal information in accordance with applicable laws of India.

The Platform may collect:

  • Name

  • Mobile Number

  • Email Address

  • Profile Photograph

  • Address

  • Identity Documents

  • Device Information

  • GPS Location (with user permission)

  • IP Address

  • Booking or enquiry history

  • Communication records

  • Technical logs

The collected information is used only for:

  • creating and managing user accounts;

  • connecting Customers and Service Providers;

  • preventing fraud and misuse;

  • responding to user queries;

  • improving platform functionality;

  • complying with legal obligations.

Hazirkar does not sell users’ personal information to third parties.

Information may be disclosed only where required by law, court order, or to protect the rights, safety, or property of Hazirkar or other users.

12. Account Suspension

Hazirkar reserves the absolute right to suspend, restrict, or permanently terminate any account without prior notice if it reasonably believes that a user has:

  • submitted false information;

  • engaged in fraudulent activity;

  • violated these Terms;

  • abused other users;

  • committed unlawful acts; or

  • otherwise misused the Platform.

13. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the Republic of India.

14. Jurisdiction

Any dispute, claim, or legal proceeding arising out of or relating to the use of the Platform or these Terms shall be subject to the exclusive jurisdiction of the competent courts located at Betul, Madhya Pradesh, India – 460001, and users irrevocably submit to the jurisdiction of such courts.

15. Modification of Terms

Hazirkar reserves the right to modify, amend, or update these Terms at any time.

Continued use of the Platform after such modifications constitutes acceptance of the revised Terms.
